These Terms & Conditions apply to your use of the Sunx Data Research website and to any services we provide to you. In these terms, “Sunx Data Research”, “we”, “us” and “our” mean Sunx Data Research. “You” and “your” mean the person or organisation using our website or engaging our services.
By using our website or engaging us, you agree to these terms. If you don’t agree, please don’t use the website or engage our services.
For each project, we will also agree a written quote or proposal with you (a “Proposal”). If a Proposal conflicts with these terms, the Proposal applies to that project.
We provide quantitative business research, macroeconomic research, data analytics (big data), data science, econometric modelling, and mathematical and statistical modelling to private-sector and public-sector clients in Australia and New Zealand. All services are delivered remotely.
The scope, deliverables, timeline and fee for each project are set out in the Proposal. Work outside the agreed scope is a variation. It will only proceed once you have agreed to it in writing, including any change in fee or timing.
Submitting an enquiry through our website doesn’t create a contract or oblige either of us to proceed. We aim to reply to enquiries within 1 business day, but this is a target, not a guarantee of any particular outcome. Our first scoping conversation is free.
A contract for services begins when you accept our Proposal in writing. Email is sufficient.
Fees. Fees are set out in the Proposal. Any “from” prices shown on our website are a guide only and don’t form an offer. The Proposal is the binding quote.
Currency and tax. Fees are quoted in Australian dollars (AUD) and exclude GST unless the Proposal says otherwise. Where GST applies, it will be shown separately on your invoice. For New Zealand clients, we will state clearly in the Proposal which currency and tax treatment applies.
Invoicing and payment. Unless the Proposal says otherwise, we invoice 50% of the fee when you accept the Proposal and 50% when we deliver the final work. For ongoing monthly services, we invoice monthly in advance. Invoices are payable within 14 days of the invoice date.
Late payment. If an invoice is overdue, we may pause work until it is paid. We will give you written notice before doing so.
Expenses. Any third-party costs, such as purchased datasets or software licences, will be agreed with you before we incur them.

Delays or gaps in the information you provide may affect our timeline and fees.
We will give you realistic timeframes in the Proposal and work to meet them. Timelines depend on you providing what we need on time and on the scope staying the same. We aren’t responsible for delays caused by circumstances outside our reasonable control.
We treat the information and data you share with us as confidential. We will only use it to deliver your project and will not disclose it to anyone else except:
You must likewise keep confidential any non-public methods, models or materials we share with you. These obligations continue after the project ends.
When a project ends, we will return or securely delete your data within 30 days of your written request, unless the law requires us to keep it.
By submitting your information to us, you understand that it may be handled in this way.
We handle personal information in line with our Privacy Policy and applicable privacy law, including the Privacy Act 1988 (Australia) and the Privacy Act 2020 (New Zealand).
If your project involves personal information, we will discuss the safest way to handle it during scoping. You are responsible for making sure you’re entitled to provide personal information to us and, where required, for having obtained the necessary consents.
We take reasonable steps to protect your data. However, no method of electronic transmission or storage is completely secure, and we can’t guarantee absolute security.
Your materials. You keep ownership of the data and materials you give us. You give us permission to use them to deliver the services.
Our deliverables. Once you have paid in full, you own the final reports and deliverables we produce specifically for you.
Our pre-existing methods. We keep ownership of our pre-existing methods, tools, code, templates and general know-how, and of any improvements to them. Nothing in these terms transfers those rights to you. To the extent our methods are part of a deliverable, you may use them as part of that deliverable for your own purposes.
Publication. Please don’t publish or share our reports outside your organisation in a way that misrepresents our findings. If you quote or publish our work, you must do so accurately and in context, and let us review the wording beforehand where reasonably possible.
Our work is research and analysis. It relies on the data, assumptions and information available at the time, and results will always involve some uncertainty. We state our assumptions and limitations in our reports.
Unless we have agreed otherwise in writing, our work isn’t legal, tax, financial, investment or other regulated advice. You should get appropriate professional advice before relying on it for those purposes. Forecasts and scenarios are estimates, not guarantees of future outcomes.
You remain responsible for the decisions you make using our work.
We will provide our services with due care and skill.
Consumer law. Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Competition and Consumer Act 2010 (including the Australian Consumer Law), the Consumer Guarantees Act 1993 (NZ), the Fair Trading Act 1986 (NZ) or any other law that can’t be excluded.
Limit of liability. Subject to the paragraph above, and to the extent the law allows:
Reliance on your information. We aren’t responsible for errors or omissions in our work that result from inaccurate or incomplete information you provided.
By you. You may cancel a project by giving us written notice. You will pay for work completed and costs incurred up to the date of cancellation. The deposit is applied against those amounts, and any balance of the deposit beyond the value of work done will be refunded.
By us. We may pause or end a project if you don’t pay on time, don’t provide information we reasonably need, or breach these terms. We will give you written notice and, where reasonable, a chance to fix the problem first.
Refunds. Fees for completed work aren’t refundable, except where the law requires it or where we agree otherwise in writing.
If you’re unhappy with any part of our service, please tell us at admin@sunxdataresearch.com. We will acknowledge your complaint within 2 business days and work with you to resolve it fairly.
You agree to use our website lawfully. You must not:
Website content. The content on this website is provided for general information and isn’t advice for your specific situation. We try to keep it accurate and up to date, but we don’t guarantee that it is complete or current.
Website ownership. The website, its text, design, logos and graphics belong to us or our licensors and are protected by copyright and other laws. You may view and print pages for your own personal or internal business use.
Third-party links. Our site may link to other websites. We don’t control them and aren’t responsible for their content or practices.
Availability. We don’t promise the website will always be available or error-free.
When you submit the enquiry form, you agree that we may contact you about your enquiry using the details you provide. We send an automatic confirmation email, and we aim to reply personally within 1 business day. We won’t send you marketing messages unless you’ve agreed to receive them, and you can opt out at any time.
We may update these terms from time to time. The updated version will be posted on this page. If you have an existing project with us, the terms in force when you accepted the Proposal continue to apply to that project unless we both agree otherwise.
